Google Faces Over Rs. 1330 Crore Fine by CCI

The Competition Commission of India, or CCI, yesterday in a tweet, informed about imposing a “monetary penalty of Rs 1337.76 crore on Google for abusing its dominant position in multiple markets in the Android Mobile device ecosystem.” The commission released a statement on its official website revealing all the details of the penalty imposed and investigation conducted. Moreover, CCI also issued a cease and detest order on the global tech giant along with a direction to modify conduct within the stipulated timeframe.

Google acquired Android, the mobile operating system which every smartphone device needs to operate and run mobile applications in 2005. Since Android has been able to capture a considerable market size when it comes to operating systems for smartphones. CCI examined all significant aspects of Google’s dealing with smartphone manufacturers including the grant of licensing its operating system. Google also licenses its other market-dominant proprietary mobile applications for manufacturers such as Play Store, Google Search, Google Chrome, YouTube etc.

CCI, in their efforts to unearth the current market practices adopted by the tech giant, examined relevant markets including licensable OS for smart mobile devices, the app store for Android smart mobile OS, general web search services, non-OS specific mobile web browsers and online video hosting platform (OVHP).

According to the official press release tweeted by the CCI handle on Twitter, the commission found out that Google has a dominant market position in all of the above-mentioned smartphone markets.

As per the CCI statement, Google enters into multiple agreements with other businesses to safeguard its rights and outline its obligations. Some of these agreements include Mobile Application Distribution Agreement (MADA), Anti-fragmentation Agreement (AFA), Android Compatibility Commitment Agreement (ACC), and Revenue Sharing Agreement (RSA).

“MADA assured that the most prominent search entry points i.e., search app, widget and Chrome browser are pre-installed on Android devices, which accorded significant competitive edge to Google’s search services over its competitors,” the CCI statement mentions.

“Further, Google also secured a significant competitive edge over its competitors, in relation to its other revenue-earning app i.e. YouTube on Android devices. The competitors of these services could never avail the same level of market access which Google secured and embedded for itself through MADA…create significant entry barriers for competitors of Google to enter or operate in the markets concerned,” the CCI states.

The statement also revealed Google’s argument of facing competition constraints from Apple Inc during the examination.

The CCI, however, clarified its position by highlighting the differences between the two business models. As per its statement, Apple’s business is primarily based on a vertically integrated smart device ecosystem that is the underlying incentive of business decisions. Apple Inc focuses on the sale of high-end smart devices with advanced software components.

“Whereas Google’s business was found to be driven by the ultimate intent of increasing users on its platforms so that they interact with its revenue earning service i.e., an online search which directly affects the sale of online advertising services by Google,” the CCI statement clarified without finding any merit in Google’s argument.

This regulatory investigation into Google’s dominant market position is not making headlines for the first time. Back in 2019, during a similar investigation, Google India countered the criticism with its argument in favour of making smartphones more affordable for millions of mobile internet users in India. However, CCI even then wasn’t convinced by the arguments presented and in a September 2021 report highlighted Google’s misconduct in abusing its position of power to specifically hurt competition in India.

In that report, the regulatory authority concluded details of how Google was forcing smartphone manufacturers to pre-install its application on the devices. Manufacturers very rarely had an option when they had to license out the operating systems from Google.

It is interesting to note at this point that most smartphone manufacturers are free to go ahead and use Google open-source projects to develop their own operating systems. However, it is various factors such as time restrictions, shortage of skilled manpower and the lure of giving its users access to Google’s Play Store that stops most manufacturers. Industry experts have often highlighted how stripping smartphone manufacturers of their Android licenses could have disastrous effects on the market.

Realme 10 is a vanilla handset that comes in two storage variants- 4GB RAM + 64GB internal capacity, and 4GB RAM + 128GB internal capacity, while Realme 10 Pro+ will come in three storage variants- 6GB RAM + 128GB, 8GB RAM + 128GB, and 8GB RAM + 256GB internal capacity.

When it comes to content moderation on social media or other online platforms, too much will always be too little. Facebook Parent Meta has been trying for a long time to fight off all the criticism that comes its way for not doing enough to mark sensitive content on its platforms. The latest addition in its series of efforts is the decision to let the Independent Oversight Board take the call on applying a warning screen on disturbing or sensitive content when reported.

The oversight board said they would now be able to take binding decisions towards appeals filed by users across the world.

In a separately released transparency report, the Meta independent board highlighted that in the second quarter of the year i.e. from 1st April till 30th June 2022, the company had received 3,47,000 appeals from the users of Facebook and Instagram across the world combined. The board report mentions, “Since we started accepting appeals two years ago, we have received nearly two million appeals from users around the world.”

“This demonstrates the ongoing demand from users to appeal Meta’s content moderation decisions to an independent body,” the report also added.

Meta’s Independent Oversight Board

Although the oversight board was first formed to take decisions on small number of content moderation appeals, over time, its role expanded. It has also been given the responsibility to advice on social media platforms’ policies and consumer decisions.

One of the board’s most significant recent decisions was its public objection to Facebook removing a newspaper report about the Taliban. Facebook removed the report terming it “positive”. However, the board clearly backed the users’ freedom of expression. They also criticised how the tech giant relies on automated moderation.

It must be noted that artificial intelligence is heavily used for content moderation in most tech companies, which is not always dependable.

More On Meta’s Independent Oversight Board

The Meta independent oversight board is the independent body formed to take content moderation decisions for Meta’s popular social media platforms, Facebook and Instagram. The initial proposal by Harvard Law School professor Noah Feldman was to create a quasi-judiciary for Facebook, an idea approved and supported by Meta CEO Mark Zuckerberg who also described it as a “Supreme Court.” According to Zuckerberg, the oversight board will have all the rights to settle, negotiate, and mediate content moderation issues. He also specified that the board would eventually have the authority to override the decision of Meta as a company.

The oversight board includes eminent academics, rights experts and lawyers.

The idea of forming a dedicated oversight board was first announced in November 2018. Zuckerberg made the announcement after having consultation sessions with many industry and law experts. Following expected industry speculations and media coverage of the idea, the first 20 founding members of the board were announced in May 2020. Later, it was on October 2020 when the board officially started its work.

ISRO to Launch Chandrayaan-3, Its Third Mission to Moon, in June 2023

In a bid to take India’s dream of interplanetary explorations one step ahead, the Indian Space Research Organisation (ISRO) is all set to launch Chandrayaan-3 in June 2023. Chandrayaan-3 will be ISRO’s third mission to the moon and one of the most ambitious space projects of the year. ISRO Chairman S Somanath while speaking to the media during an event revealed, “Chandrayaan-3 (C-3) launch will be in June next year onboard the Launch Vehicle Mark-3 (LVM3).”

Apart from disclosing the timeline for Chandrayaan-3, ISRO officials also lined up plans for the country’s first human spaceflight. The first test flight of the ‘abort mission for Gaganyaan is scheduled for a launch early next year. This is in line with India’s next ambitious space mission, which involves for the first time flying Indian astronauts into orbit by the end of 2024.

As per reports, ISRO is planning to carry out six test flights before it goes ahead and launches the first human spaceflight in 2024. Somanath didn’t shy away from revealing that one of the country’s most awaited space missions Gaganyaan is rightfully progressing at an expected slow and steady pace.

What We Know About Chandrayaan-3 So Far

Chandrayaan-3 is the mission to the moon proposed and planned after the unfortunate soft landing failure of Chandrayaan-2.

Chandrayaan-2 was ISRO’s second lunar exploration mission launched in 2019 after the completion of the previous mission, Chandrayaan-1. On 22 July 2019, the C-2 spacecraft was launched from the Satish Dhawan Space Centre, Andhra Pradesh on a mission to the Moon. The ultimate mission was to explore and study the lunar surface composition along with detecting the lunar water location.

The C-2 spacecraft was carrying a lunar orbiter and India’s indigenously developed Vikram lander and Pragyan lunar rover. Although the craft successfully reached Moon’s orbit and started orbital operations needed for the preparation for the soft landing of Vikram lander, due to some software glitch the lander deviated from its trajectory losing the momentum to finally facing a crash at landing.

ISRO to Launch Chandrayaan-3

Chandrayaan-3 since then have become ISRO’s next project to re-attempt a soft landing on the lunar surface in 2023 and complete the lunar objectives set for C-2.

The major difference between Chandrayaan-2 and Chandrayaan-3 would be the absence of an orbiter. Chandrayaan-3 will not have an orbiter and will only carry a lander and a rover to the moon.

On the design front, Chandrayaan-3 is programmed to have some design changes as well.

The Chandrayaan-3 lander will have only four throttle-able engines. This is different from Vikram lander on Chandrayaan-2, which had five 800 Newtons engines. The fifth engine on Chandrayaan-2 was centrally mounted with a fixed thrust. Moreover, the lander of the proposed Chandrayaan-3 craft will also be equipped with a Laser Doppler Velocimeter (LDV).

“C-3 is ready now. It is not a replica of C-2. The rover is there. The engineering is significantly different. We have made it more robust so that it does not have problems like last time,” Somanath added during his interactions with the media personnel.

About the Abort Missions

Abort missions are test flights where the space crew needs to abort the mission in case of a system or other failure. The crew in that case needs to escape the spacecraft in the middle of an ongoing flight. An Abort Mission is basically a test flight that is designed for the crew to practice how to manage a space escape in case of failures. Through these missions, ISRO will be testing the systems with the crew before planning the launch of human spaceflights.

According to ISRO’s updated brief, the Gaganyaan mission is envisaging a manned spaceflight to Low Earth Orbit (LEO) for the first time by Indian space scientists and astronauts. This mission, when performed successfully, will play an instrumental role as the foundation stone for a future Indian human space exploration programme.

Speaking of the first test flight of the abort mission for Gaganyaan planned for early next year, Somanath said, “If this is successful, we will repeat it once again and then we will go for an unmanned mission. The unmanned mission will be a full-fledged rocket. It will go to orbit, then it will come back.”

Customers purchasing the Cadbury celebrations pack this Diwali can now simply by scanning the QR code printed on the pack get to know all about their local hawkers. Cadbury has again manual gathered the data of local hawkers and marked them through a QR code. Customers would be able to get all the information about nearby hawkers and the products they sell.

The technology also builds a simple interface for the consumers purchasing a Cadbury celebrating pack where they can promote their local hawkers. Consumers, by scanning the QR code, can now even set up a small virtual shop for their local vendors. They can add useful details such as the hawker’s name, phone number, and the list of products they sell. Other customers can easily shop for these listed products from registered hawkers.

“We are not just in the business of storytelling, we want to engage consumers and get them to participate and be involved in what we are trying to say. Viswanathan also revealed how the brand has some other ideas for this Diwali as well but keeping the factor of continuity with the previous year’s campaign in mind, this idea was finalised.

The brand is, with its message-orient campaigning, trying its best to build a thoughtful narrative around the idea of showing generosity for the past two years. And for the worth of its last two campaigns, it is not hard to notice that the idea behind its messaging is working.

Viswanathan also added, “Over the years, we have been building many chapters of generosity, whether it the generosity we were showing towards Covid warriors, or to say thank you to each other, or being generous to some people. It’s been a long journey.”

CCI has further instructed Google to provide a defined timeline and modify its conduct instead of using its position and reputation for its own benefits and leveraging its dominance in the app store market.

Many Android smartphone users in India have leveled complaints on Google, based on which Competition Commission of India has ordered a detailed probe on the tech giant. For the unversed, Android is an open-source, mobile operating system that is installed by Original Equipment Manufacturers (OEMs) of smartphones, laptops, tablets, etc.

There are two agreements on which the allegations levelled on Google are based viz. Anti-Fragmentation Agreement (AFA) and Mobile Application Distribution Agreement (MADA), which were entered into Android OS OEMs.

CCI has also deemed the pre-installing Google Mobile Suite (GMS) under MADA, along with their prominent placement, as good as imposing of unfair conditions on device manufacturers as it contravenes the competition law, especially as there is no option to uninstall it.

Therefore, CCI has imposed the financial penalty on Google as the company has violated Section 4(2)(d) of the Competition Act, which is the code for violation of dominant position.

This alleged action by Google apparently denies market access for competing search apps, which is another violation of the competition law, as the tech giant seeks to enter as well as protect its position in non-OS specific web browser market via the Google Chrome app.

Amazon, in its defense, has refuted the allegations and claimed the proposed case is ‘without merit’ and plans to take the matter further as this is the newest case against a reputed tech giant that will be filed at Competition Appeal Tribunal (CAT), London.

Hausfeld is the law firm that is representing advocate Hunter, which has accused Amazon of breaching competition law via a secretive and self-favouring algorithm’ to promote its own products on its official website, for which it is using its ‘Buy Box’ feature for the task.

Amazon has confidently claimed that the claims lack merit and will be cleared through the legal process as the case is under subjugation since July 2022, with UK’s antitrust watchdog carrying on its investigations like the company’s way of selecting its products to be placed in the ‘Buy Box’ feature.

This isn’t the only legal hassle that Amazon is involved in as it has faced many similar probes elsewhere too, like the one where it offered a hefty sum to the European Commission to avert possible hefty EU antitrust fines.

Amazon has even declined to comment on its product-search system to an Australian Competition regulator, which has also heard complaints of platforms with large marketplaces of preferring in-house wares.
