The Competition Commission of India (CCI) is all set to take legal action against WhatsApp for allegedly violating competition laws related. The popular messaging app reportedly allowed specific user data to be shared with Meta. This raises concerns over both user privacy and competition fairness.

According to a recent Livemint report, the Director General of CCI has submitted its report. The report concludes that both WhatsApp and Meta misused their positions and breached Indian competition regulations.

It allows the instant messaging app to access sensitive business transaction data.

Penalties for WhatsApp and Meta

WhatsApp and Meta could face penalties for their actions if the CCI drafts a proposal based on the CCI report is approved. Certain media reports suggest that the draft alleges that the companies commonly exploited their market power.

The actions left a damaging impact on competition and privacy.

In response to the recent allegation, a WhatsApp spokesperson said, “CCI proceedings are sub-judice, and we can’t comment on it. WhatsApp gave users the choice of accepting the Privacy Policy Update, and users who chose not to accept the update continue to use WhatsApp to communicate with friends and family without having their accounts deleted or losing functionality.”

The case highlights the growing concern over data privacy. It also underlines the role of big tech companies in shaping competition in digital markets.

According to the Competition Act revision in 2023, CCI is allowed to slap penalties of up to 10% of the average turnover for the preceding three financial years on guilty companies.
